Terms of Service

These Terms govern your use of TurnLeaf, a web-based gardening companion app (the “Service”). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. The Service

TurnLeaf helps you choose plants suited to your window's sunlight and reminds you when to water, harvest, and resow. The Service is provided free of charge during early access.

2. Your account

You're responsible for keeping your login credentials secure and for everything that happens under your account. You must be at least 13 years old to create an account.

4. Your content and data

Your gardens, plants, tasks, and harvest log belong to you. By using the Service, you grant us a limited license to host, store, and process that data only as needed to provide the Service to you. You can request deletion at any time (see the Privacy Policy).

5. Our intellectual property

The Service itself — including the TurnLeaf name, logo, software, artwork, and design — is ours. You don't get any rights to it except the limited right to use the Service under these Terms.

6. No warranty — gardening outcomes

TurnLeaf provides general gardening guidance based on publicly available sunlight and weather data. We don't guarantee that any plant will germinate, grow, produce a harvest, or be safe to eat. Outcomes depend on many factors outside our control (including your specific environment, the seeds you use, water quality, pests, and your own care).

You are solely responsible for the safety of anything you grow and consume. Don't eat a plant unless you've independently confirmed it is what you think it is, grown in safe conditions, and safe for you to eat.

7. “As is” — no warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We don't warrant that the Service will be error-free, secure, or continuously available.

8. Limitation of liability

To the maximum extent allowed by law, TurnLeaf and the people running it will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to the Service — even if we've been told such damages are possible.

Our total liability for any claim related to the Service will not exceed the greater of (a) the total amount you paid us in the twelve months before the claim arose, or (b) fifty US dollars ($50).

Some jurisdictions don't allow these limits, so they may not apply to you.

9. Indemnification

You agree to indemnify and hold TurnLeaf harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.

10. Termination

You can stop using the Service at any time and delete your account from your settings or by emailing us. We may suspend or terminate your access if you violate these Terms, if we're required to by law, or if we discontinue the Service. Sections that by their nature should survive termination (intellectual property, disclaimers, liability, indemnification, governing law) will survive.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Service or these Terms will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

To the extent permitted by law, you and TurnLeaf each waive any right to a jury trial and any right to bring or participate in a class action.

12. Changes

We may update these Terms from time to time. If we make material changes, we'll update the “last updated” date above and, where appropriate, notify you in the app or by email. Continued use of the Service after a change means you accept the new Terms.
